                                     AN ACT

     1  Amending the act of March 4, 1971 (P.L.6, No.2), entitled "An
     2     act relating to tax reform and State taxation by codifying
     3     and enumerating certain subjects of taxation and imposing
     4     taxes thereon; providing procedures for the payment,
     5     collection, administration and enforcement thereof; providing
     6     for tax credits in certain cases; conferring powers and
     7     imposing duties upon the Department of Revenue, certain
     8     employers, fiduciaries, individuals, persons, corporations
     9     and other entities; prescribing crimes, offenses and
    10     penalties," further providing for disposition of certain
    11     funds relating to the cigarette tax.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 1296 of the act of March 4, 1971 (P.L.6,
    15  No.2), known as the Tax Reform Code of 1971, amended June 29,
    16  2002 (P.L.559, No.89), is amended to read:
    17     Section 1296.  Disposition of Certain Funds.--Receipts from

     1  the tax imposed by this article shall be deposited into the
     2  General Fund. Twenty million four hundred eighty-five thousand
     3  dollars ($20,485,000) of the receipts deposited into the General
     4  Fund in accordance with this section shall be transferred
     5  annually to the Agricultural Conservation Easement Purchase
     6  Fund. Thirty million seven hundred thirty thousand dollars
     7  ($30,730,000) of the receipts deposited into the General Fund in
     8  accordance with this section shall be transferred annually to
     9  the Children's Health Fund for health care for indigent
    10  children. Two million dollars ($2,000,000) of the receipts
    11  deposited into the General Fund in accordance with this section
    12  shall be allocated annually to the Department of Health for the
    13  purpose of prostate cancer research as prescribed under the
    14  department's cancer control program. The transfers required by
    15  this section shall be made in two equal payments by July 15 and
    16  January 15.
    17     Section 2.  This act shall take effect July 1, 2005, or
    18  immediately, whichever is later.
