AN ACT
1 Amending the act of August 12, 1971 (P.L.299, No.75), entitled
2 "An act regulating snowmobiles, providing for registrations
3 and fees, and providing penalties," further providing for
4 operation of snowmobiles.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Subsection (c) of section 4, act of August 12,
8 1971 (P.L.299, No.75), entitled "An act regulating snowmobiles,
9 providing for registrations and fees, and providing penalties,"
10 is amended to read:
11 Section 4. Operation.--* * *
12 (c) Except as otherwise provided in this act, it shall be
13 unlawful to operate a snowmobile on any street or highway which
14 is not designated and posted as a snowmobile road by the
15 governmental agency having jurisdiction. It shall be lawful to <--
16 operate a snowmobile on the berm of highways and secondary roads
17 and to operate on secondary roads when so designated and posted
18 by the local governmental unit having jurisdiction. A POLITICAL <--
1 SUBDIVISION OF ANY COUNTY SHALL HAVE THE AUTHORITY TO DESIGNATE
2 ANY ROAD OR STREET WITHIN ITS JURISDICTION AS A SNOWMOBILE
3 STREET OR ROAD AND MAY, IN ITS DISCRETION, DETERMINE WHETHER
4 SUCH STREET OR ROAD SHALL BE CLOSED TO VEHICULAR TRAFFIC OR
5 WHETHER SNOWMOBILES MAY SHARE THIS DESIGNATED STREET OR ROAD
6 WITH VEHICULAR TRAFFIC: PROVIDED, THAT ADEQUATE NOTICES ARE
7 SUFFICIENTLY AND PROMINENTLY DISPLAYED. THIS ACT DOES NOT
8 PERTAIN TO STATE HIGHWAYS.
