AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, providing for the crime of theft by
3 government officials and employees.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 18, act of November 25, 1970 (P.L.707,
7 No.230), known as the Pennsylvania Consolidated Statutes, is
8 amended by adding a section to read:
9 § 3932. Theft by government officials and employees.
10 (a) Unauthorized disposal.--A person is guilty of theft if,
11 being an official, officer, agent or employee of a government,
12 he disposes of or authorizes or permits the disposal of any
13 services, materials, supplies or labor belonging to, or paid or
14 contracted for by the government in any work or construction
15 whatsoever, whether gratuitously or for a consideration, for
16 private rather than public benefit, unless such disposal is
17 required by law.
18 (b) Unauthorized use.--A person is guilty of theft if, being
19 an official, officer, agent or employee of a government, he uses
1 any portion of the property of the government for private
2 benefit without the consent of the government.
3 Section 2. This act shall take effect in 60 days.
