1Amending Title 42 (Judiciary and Judicial Procedure) of the
2Pennsylvania Consolidated Statutes, further providing for the
3disbursement of the proceeds from forfeited property.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1.  Section 6801 of Title 42 of the Pennsylvania
7Consolidated Statutes is amended by adding a subsection to read:

8§ 6801.  Controlled substances forfeiture.

10(l)  Municipal police agency share of proceeds.--Whenever a
11municipal police agency was substantially involved in the
12seizure of property ultimately forfeited by the court, the
13proceeds shall be distributed so as to allocate at least 25% to
14the municipal police agency. This percentage may be increased by
15agreement. If more than one such agency is so involved, the
16court shall equitably determine what portion of the 25% shall be
17allocated to each agency.

18Section 2.  This act shall take effect in 60 days.
