           REPRESENTATIVES, AS AMENDED, MAY 6, 1985

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," requiring school courses relating to
     6     the cause and prevention of drug and alcohol abuse; mandating
     7     a certified addiction counselor be employed by each district;
     8     and providing funding.

     9     The General Assembly of the Commonwealth of Pennsylvania
    10  hereby enacts as follows:
    11     Section 1.  Section 1605 of the act of March 10, 1949
    12  (P.L.30, No.14), known as the Public School Code of 1949, is
    13  amended by adding subsections to read:
    14     Section 1605.  Courses of Study.--* * *
    15     (c)  Each student in grades kindergarten through ten TWELVE    <--
    16  inclusive shall receive a mandatory alcohol and chemical abuse
    17  informational course of study. The course of study shall be       <--
    18  developed by the Department of Health. OR APPROVED BY THE         <--


     1  DEPARTMENT OF HEALTH, OFFICE OF DRUG AND ALCOHOL PROGRAMS, AND
     2  SHALL INCLUDE, BUT NOT BE LIMITED TO, DRUG AND ALCOHOL
     3  INFORMATION, PREVENTION PROGRAMMING AND INTERVENTION
     4  PROGRAMMING. THE COURSE OF STUDY MAY BE INTEGRATED INTO EXISTING
     5  HEALTH INSTRUCTION COURSES.
     6     (d)  In addition to the mandatory course set forth in
     7  subsection (c), each school district shall employ at least one    <--
     8  certified addiction counselor for student problems relating to
     9  drug, alcohol or chemical abuse. HAVE AN AGREEMENT OR CONTRACT    <--
    10  WITH OR SHALL EMPLOY A PERSON OR ORGANIZATION APPROVED BY THE
    11  OFFICE OF DRUG AND ALCOHOL PROGRAMS OR A CERTIFIED ADDICTIONS
    12  COUNSELOR TO HANDLE SCREENING AND REFERRAL OF STUDENTS WITH
    13  PROBLEMS RELATING TO DRUG, ALCOHOL OR CHEMICAL ABUSE.
    14     (e)  The provisions of subsections (c) and (d) shall be
    15  funded by the tax revenues generated by the act of June 9, 1936
    16  (Sp.Sess., P.L.13, No.4), entitled, as reenacted and amended,
    17  "An act imposing an emergency State tax on liquor, as herein
    18  defined, sold by the Pennsylvania Liquor Control Board;
    19  providing for the collection and payment of such tax; and
    20  imposing duties upon the Department of Revenue and the
    21  Pennsylvania Liquor Control Board." BOARD," OR SUCH ACTS          <--
    22  REPEALING OR RECODIFYING THE SAME.
    23     Section 2.  This act shall apply to the school year next
    24  commencing after the effective date of this act and to each
    25  school year thereafter.
    26     Section 3.  This act shall take effect immediately.
