        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JUNE 1, 1987

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, increasing the penalty for scattering
     3     rubbish.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6501 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6501.  Scattering rubbish.
     9     (a)  Offense defined.--A person is guilty of an offense if
    10  he:
    11         (1)  throws any waste paper, sweepings, ashes, household
    12     waste, glass, metal, refuse or rubbish, or any dangerous or
    13     detrimental substance into or upon any road, street, highway,
    14     or alley, or upon the land of another or into or upon any
    15     stream or navigable river; or
    16         (2)  interferes with, scatters, or disturbs the contents
    17     of any receptacle containing ashes, garbage, household waste,

     1     or rubbish.
     2     (b)  [Penalty.--A person who violates the provisions of this]  <--
     3  GRADING.--                                                        <--
     4         (1)  A PERSON WHO VIOLATES THIS section WITH LESS THAN 20  <--
     5     GALLONS OF MATERIAL PROHIBITED BY THIS SECTION is guilty of a
     6     summary offense and upon conviction thereof shall be
     7     sentenced to pay a fine of not less than [$10] $50 nor more    <--
     8     than [$300] $1,000 or to imprisonment for not more than 90
     9     days, or both.
    10         (2)  A PERSON WHO VIOLATES THIS SECTION WITH MORE THAN 20  <--
    11     GALLONS OF MATERIAL PROHIBITED BY THIS SECTION OR WITH A
    12     CONTAINER WITH A CAPACITY OF 20 GALLONS OR MORE CONTAINING
    13     MATERIAL PROHIBITED BY THIS SECTION IS GUILTY OF A
    14     MISDEMEANOR OF THE THIRD DEGREE.
    15     Section 2.  This act shall take effect immediately.
