                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," providing for nonbinding advisory questions.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  The act of June 3, 1937 (P.L.1333, No.320), known
    15  as the Pennsylvania Election Code, is amended by adding a
    16  section to read:
    17     Section 302.1.  Nonbinding Advisory Questions.--A county
    18  board of elections may cause a nonbinding advisory question to
    19  be placed on the ballot whenever the governing body of a
    20  municipality or school district, which proposes to make an


     1  expenditure the total cost of which is equal to or greater than
     2  an amount equal to ten (10) per centum of the municipality's or
     3  school district's operating budget for the immediately preceding
     4  fiscal year, adopts, by majority vote, a resolution asking the
     5  county board to place on the ballot a question to determine the
     6  will of the electorate of the municipality or school district
     7  with respect to said expenditure. The governing body of the
     8  municipality or school district shall file a copy of the
     9  resolution with the county board. Any such question placed on
    10  the ballot shall be submitted to the electorate at the next
    11  general, municipal or primary election occurring more than
    12  thirty days after the date of the filing of the resolution.
    13     Section 2.  This act shall take effect in 60 days.
