                                     AN ACT

     1  Amending the act of May 13, 1915 (P.L.286, No.177), entitled, as
     2     amended, "An act to provide for the health, safety, and
     3     welfare of minors: By forbidding their employment or work in
     4     certain establishments and occupations, and under certain
     5     specified ages; by restricting their hours of labor, and
     6     regulating certain conditions of their employment; by
     7     requiring employment certificates for certain minors, and
     8     prescribing the kinds thereof, and the rules for the
     9     issuance, reissuance, filing, return, and recording of the
    10     same; by providing that the Industrial Board shall, under
    11     certain conditions, determine and declare whether certain
    12     occupations are within the prohibitions of this act;
    13     requiring certain abstracts and notices to be posted;
    14     providing for the enforcement of this act by the Secretary of
    15     Labor and Industry, the representative of school districts,
    16     and police officers; and defining the procedure in
    17     prosecutions thereunder, and establishing certain
    18     presumptions in relation thereto; providing for the issuance
    19     of special permits for minors engaging in the entertainment
    20     and related fields; providing penalties for the violation of
    21     the provisions thereof; and repealing all acts or parts of
    22     acts inconsistent therewith," further providing for minor
    23     volunteer fire company, volunteer ambulance corps, volunteer
    24     rescue squads and volunteer forest fire crew member
    25     activities.

    26     The General Assembly of the Commonwealth of Pennsylvania
    27  hereby enacts as follows:
    28     Section 1.  Subsections (a), (d), (f) and (g) of section 7.3,
    29  act of May 13, 1915 (P.L.286, No.177), known as the "Child Labor

     1  Law," amended or added June 27, 1973 (P.L.70, No.30) and May 20,
     2  1976 (P.L.130, No.57), are amended to read:
     3     Section 7.3.  Minor Volunteer Fire Company, Volunteer
     4  Ambulance Corps, Volunteer Rescue Squads and Volunteer Forest
     5  Fire Crew Member Activities.--(a)  Minors who are members of a
     6  volunteer fire company and volunteer forest fire crew or who are
     7  engaged in or associated with those activities may participate
     8  in training and fire-fighting activities as follows:
     9     (1)  Drivers of trucks, ambulances or other official fire
    10  vehicles must be eighteen years of age.
    11     (2)  Minors sixteen and seventeen years of age who have
    12  successfully completed a course of training equal to the
    13  standards for basic fire-fighting established by the Department
    14  of Education and the Department of Environmental Resources, may
    15  engage in fire-fighting activities provided that such minors are
    16  under the direct supervision and control of the fire chief, an
    17  experienced line officer or a designated forest fire warden.
    18     (3)  No person under eighteen years of age shall be permitted
    19  to (i) operate an aerial ladder, aerial platform or hydraulic
    20  jack, (ii) use rubber electrical gloves, insulated wire gloves,
    21  insulated wire cutters, life nets or acetylene cutting units,
    22  (iii) operate the pumps of any fire vehicle while at the scene
    23  of a fire or (iv) enter a burning structure.

    25     (d)  All other activities by minors who are members of a
    26  volunteer fire company or a volunteer forest fire crewman or who
    27  are engaged in or associated with these activities shall be
    28  permissible unless specifically prohibited by this act.
    29     * * *
    30     (f)  All other existing provisions of this act and the

     1  regulations promulgated thereunder affecting the employment of
     2  minors shall be applicable in all cases, including the
     3  requirements for employment certificates and the limitations on
     4  hours of employment: Provided, That a minor sixteen or seventeen
     5  years of age who is a member of a volunteer fire company or who
     6  is engaged in or associated with these activities who answers a
     7  fire call while lawfully employed and continues in such service
     8  until excused by the one acting as chief of that fire company
     9  shall not be considered in violation of this act for any part of
    10  the period so occupied.
    11     (g)  Any minor who is a member of a volunteer ambulance corps
    12  or rescue squad or who is engaged in or associated with these
    13  activities may participate in training and any other activity as
    14  provided by regulations adopted by the Department of Labor and
    15  Industry but in any case, drivers of all ambulances or other
    16  official ambulance corps or rescue squad vehicles must be
    17  eighteen years of age.
    18     Section 2.  This act shall take effect immediately.
