                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for selling or
     3     furnishing liquor or malt or brewed beverages to minors.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6310.1(a) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 6310.1.  Selling or furnishing liquor or malt or brewed
    10             beverages to minors.
    11     (a)  Offense defined.--Except as provided in subsection (b),
    12  a person commits a misdemeanor of the third degree if he
    13  intentionally [and] or knowingly sells or intentionally [and] or
    14  knowingly furnishes, or purchases with the intent to sell or
    15  furnish, any liquor or malt or brewed beverages to a person who
    16  is less than 21 years of age.
    17     (a.1)  Mistake as to age.--It is no defense that the

     1  defendant did not have actual knowledge that the person to whom
     2  the liquor or malt or brewed beverage was furnished or sold was
     3  less than 21 years of age.
