                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for the securing of loads in
     3     vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 4903 of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended by adding subsections to read:
     8  § 4903.  Securing loads in vehicles.
     9     * * *
    10     (c.1)  Open trucks hauling loose material.--All open trucks,
    11  while hauling loads of coal, loose sand, cinders, gravel, stones
    12  and dirt, shall have a tarpaulin or other adequate and suitable
    13  cover over the material which will prevent its falling, spilling
    14  or blowing upon the highway. The driver of an open truck that
    15  deposits this material on the highway shall be responsible for
    16  removing the material.

     1     (f)  Penalty.--A person who violates subsection (c.1) commits
     2  a summary offense and shall, upon conviction, be sentenced to
     3  pay a fine not exceeding $100, or undergo imprisonment for a
     4  term not exceeding five days, or both.
     5     Section 2.  This act shall take effect in 60 days.
