                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor and the Secretary of Public Welfare,
     3     to sell and convey a certain lot or tract of land situate in
     4     the Borough of Emsworth, Allegheny County, Pennsylvania.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  The Department of General Services, with the
     8  approval of the Governor and the Secretary of Public Welfare, is
     9  hereby authorized and directed on behalf of the Commonwealth of
    10  Pennsylvania, to grant and convey in fee simple to the Borough
    11  of Emsworth, Allegheny County, Pennsylvania, for a consideration
    12  of $1, a tract of land situate in the Borough of Emsworth,
    13  County of Allegheny, Commonwealth of Pennsylvania, bounded and
    14  described as follows:
    15     All that certain land or property situated in Emsworth
    16  Borough and being part of Purparts I, L, and K of the Nancy
    17  Gilleland Partition Plan recorded CP No. 2, Doc. 2, Page 401 of
    18  Allegheny County and more particularly bounded and described as

     1  follows to wit:
     2     Beginning at the centerline of Huntington Avenue (40 feet in
     3  width) at the intersection with the westerly line of the
     4  Kingsland Place Plan of lots as recorded in Plan Book Volume 37,
     5  Page 26, in the Recorder of Deeds Office, Allegheny County;
     6  thence along the westerly line of Lots 1 through 8 of the Kings
     7  Place Plan a distance of 477.65 feet more or less to the
     8  northerly line of the Ohio River Boulevard (State Route No. 65,
     9  120 feet in width); thence along the northerly side of the Ohio
    10  River Boulevard by a curve curving to the right a distance of
    11  138 feet more or less; then continuing along the northerly line
    12  of the Ohio River Boulevard a distance of 387 feet more or less
    13  to a point where the dividing line between Emsworth Borough and
    14  Kilbuck Township intersects the northerly line of the Ohio River
    15  Boulevard; thence along the dividing line between Emsworth
    16  Borough and Kilbuck Township the following courses and
    17  distances: north 4 degrees 15 minutes west 85 feet more or less,
    18  north 27 degrees 15 minutes east 259.38 feet, north 13 degrees
    19  45 minutes east 273.17 feet to the center line of Huntington
    20  Avenue; thence along the center line of Huntington Avenue the
    21  following courses and distances: south 58 degrees 45 minutes
    22  east 198.73 feet and south 53 degrees 15 minutes east 376.15
    23  feet to a point at the place of beginning. Containing 6.58 acres
    24  more or less.
    25     The conveyance shall be made under and subject to all
    26  easements, servitudes and rights of others, including but not
    27  confined to streets, roadways and right of any telephone,
    28  telegraph, water, electric, sewer, gas or pipeline companies, as
    29  well as under and subject to any interest, estates or tenancies
    30  vested in third persons, whether or not appearing of record, for

     1  any portion of the land or improvements erected thereon.
     2     Section 2.  The deed of conveyance shall contain a clause
     3  that the lands conveyed shall be used for recreational and
     4  public purposes by the Borough of Emsworth upon such terms and
     5  conditions relative to development, maintenance and
     6  compatibility with State use as are reasonable to the Secretary
     7  of Public Welfare and if at any time the said Borough of
     8  Emsworth or its successor in function conveys said property or
     9  permits said property to be used for any purpose other than
    10  those aforementioned, the title thereto shall immediately revert
    11  to and revest in the Commonwealth of Pennsylvania.
    12     Section 3.  Costs and fees incidental to this conveyance
    13  shall be borne by the grantee.
    14     Section 4.  The deed of conveyance shall be approved as
    15  provided by law and shall be executed by the Secretary of
    16  General Services in the name of the Commonwealth of
    17  Pennsylvania.
    18     Section 5.  This act shall take effect immediately.
