A RESOLUTION

Providing for the establishment of a select committee to

2

investigate the degree to which minority-owned business

3

enterprises, women-owned business enterprises and

4

disadvantaged-owned business enterprises have been utilized

5

in contracts awarded by the Commonwealth of Pennsylvania.

6

WHEREAS, Over the past two decades numerous legislative

7

proposals, resolutions, gubernatorial proclamations and

8

executive orders have encouraged the development of programs,

9

policies and practices designed to ensure participation by

10

minority-owned, women-owned and disadvantaged-owned business

11

enterprises in contracts and services awarded by the

12

Commonwealth and its agencies, boards, commissions and

13

authorities; and

14

WHEREAS, Federal, State and local government inclusion

15

programs have existed and operated successfully for nearly three

decades; and

17

WHEREAS, Analytical studies reveal the level of the

18

Commonwealth's performance in the creation of programs to ensure

19

participation by minority-owned, women-owned and disadvantaged-

owned business enterprises in contracting, as well as that of

2

the Federal Government, other states and some local governments;

3

and

4

WHEREAS, The findings of these studies evidence the need for

5

and importance of providing opportunities for the development

6

and growth of nontraditionally owned small business enterprises;

7

and

8

WHEREAS, A national study concluded that a substantial

9

percentage of newly created jobs are provided by firms that

10

employ fewer than 20 persons; and

11

WHEREAS, Not unlike many small businesses, minority-owned,

12

women-owned and disadvantaged-owned business enterprises have

13

the potential of producing jobs to help reduce unemployment,

14

thereby helping the unemployed and underemployed achieve

15

economic independence; and

16

WHEREAS, The nation is experiencing a deep economic recession

17

that has resulted in the loss of hundreds of thousands of jobs a

18

month nationwide and a high rate of unemployment; and

19

WHEREAS, Pennsylvanians Statewide have not escaped the

20

economic downturn and have suffered job loss, loss of health

21

care benefits and, in some cases, home foreclosures; and

22

WHEREAS, Small businesses are the backbone of Pennsylvania's

23

economy; and

24

WHEREAS, The national and global financial crisis, the high

25

rate of unemployment, the high cost of goods and services and

26

the resulting economic depression have combined to require the

27

development and implementation of activities by the Federal

28

Government to stimulate the national economy; and

29

WHEREAS, The Congress is considering legislation, the

30

American Recovery and Reinvestment Act of 2009, under which the

Commonwealth of Pennsylvania anticipates receiving significant

2

Federal funds for infrastructure projects and other State

3

government needs; and

4

WHEREAS, Congressional passage and Presidential approval of

5

the American Recovery and Reinvestment Act and the subsequent

6

allocation of funds to this Commonwealth make it necessary and

7

appropriate to ensure that minority-owned, women-owned and

8

disadvantaged-owned business enterprises are in a position to

9

participate fully in economic recovery activities anticipated by

10

the Federal Government; and

11

WHEREAS, The Commonwealth appropriates millions of dollars

12

for infrastructure projects and goods and services annually; and

13

WHEREAS, Owners of minority-owned, women-owned and

14

disadvantaged-owned business enterprises have expressed concern

15

over the failure of the Commonwealth to fully utilize their

16

businesses in contracting and procurement activities; therefore

17

be it

18

RESOLVED, That the Speaker of the House of Representatives

19

appoint a select committee to consist of seven members, four

20

from the majority party and three from the minority party, to

21

investigate the awarding of Commonwealth contracts for the

22

purpose of ascertaining the degree to which minority-owned,

23

women-owned and disadvantaged-owned business enterprises have

24

been awarded Commonwealth contracts between January 1, 19952000,

and December 31, 2008, the number of all such contracts awarded

26

by industry classificationappropriate categories, the number

<--

27

awarded by subject of business enterprise, the geographic

28

location of the contracts and the total monetary value of such

29

contracts; and be it further

30

RESOLVED, That the select committee may hold hearings, take

testimony and make investigations at such places as it deems

2

appropriate in this Commonwealth; and be it further

3

RESOLVED, That the work of the select committee include an

investigation of barriers, including, but not limited to,

5

institutional barriers and money, management and market barriers

6

that may constrain participation by minority-owned, women-owned

7

and disadvantaged-owned business enterprises in this

8

Commonwealth's contracting and procurement activities and an

9

identification of any specialized approaches for eliminating

10

such barriers; and be it further

11

RESOLVED, That the select committee issue a report of its

12

investigation, which shall include any recommendations the

13

select committee deems appropriate, to the House of

14

Representatives within six months of the adoption of this

15

resolution.
