AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, providing for receipt and processing of 3 applications and fees within maintenance districts. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 6102 of Title 75 of the Pennsylvania 7 Consolidated Statutes is amended to read: 8 § 6102. Powers and duties of department and local authorities. 9 (a) Department.--The department is charged with the duty of 10 administering the provisions of this title and of all laws the 11 administration of which is now or hereafter vested in the 12 department. For the purpose of administering those provisions of 13 this title relating to certificates of title, licensing of 14 drivers and registration of motor vehicles, the department shall 15 assign and equip personnel in the headquarters facility of, or 16 elsewhere within, each maintenance district who shall, on a fee 17 basis, receive and process applications and fees for and issue
1 the appropriate certificates, cards and plates. In lieu of 2 assigning and equipping personnel in the headquarters facility 3 of, or elsewhere within, a maintenance district, the department 4 may enter into an agreement whereby the treasurer of each county 5 in that maintenance district or the Pennsylvania State Police of 6 at least one barracks in that maintenance district acts, on a 7 fee basis, as agent for the department in receiving and 8 processing applications and fees for and issuing the appropriate 9 certificates, cards and plates within that county or maintenance 10 district. 11 (b) Local authorities.--Local authorities may exercise the 12 powers granted in this chapter only by duly enacted ordinances 13 of their governing bodies. 14 Section 2. The Department of Transportation shall submit to 15 the General Assembly proposed fees for the recovery of the costs 16 incurred by the department, the county treasurers and the 17 Pennsylvania State Police in carrying out the purposes of this 18 act. No fees shall become effective until they have been enacted 19 into law and the department may defer the implementation of this 20 act until the enactment of such fees. 21 Section 3.
