AN ACT 1 Amending the act of February 1, 1966 (1965 P.L.1656, No.581), 2 entitled "An act concerning boroughs, and revising, amending 3 and consolidating the law relating to boroughs," further 4 providing for specific powers of boroughs relating to care 5 and erection of memorials and municipal music. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 1202(60) and (62) of the act of February 9 1, 1966 (1965 P.L.1656, No.581), known as The Borough Code, are 10 amended to read: 11 Section 1202. Specific Powers.--The powers of the borough 12 shall be vested in the corporate authorities. Among the specific 13 powers of the borough shall be the following, and in the 14 exercise of any of such powers involving the enactment of any 15 ordinance or the making of any regulation, restriction or 16 prohibition, the borough may provide for the enforcement thereof 17 and may prescribe penalties for the violation thereof or for the 18 failure to conform thereto: 19 * * *
1 (60) Care and erection of memorials. To take charge of, care 2 for, maintain and keep in good order and repair, at the expense 3 of the borough, any soldiers monument, gun, or carriage, or 4 similar memorial situated in the borough, and not in the charge 5 or care of any person, body, or organization, and not put up or 6 placed by the Government of the United States, the Commonwealth 7 of Pennsylvania, or the commissioners of the county, or by the 8 direction or authority of any other State of the Union, and to 9 receive from any person or organization any moneys or funds 10 which can be used for the maintenance of such memorials, and to 11 expend the same; and to erect or contribute to the erection of, 12 memorials in honor of those who served in any war in which the 13 United States was engaged[, at a cost or in a sum not to exceed 14 one thousand dollars ($1000),] and thereafter to properly and 15 adequately maintain the same. 16 * * * 17 (62) Municipal music. To appropriate money[, not in excess 18 of the sum of one thousand dollars ($1000), annually,] for the 19 expense of municipal music. 20 * * * 21 Section 2. This act shall take effect in 60 days.
