AN ACT 1 Amending the act of August 14, 1991 (P.L.342, No.36), entitled 2 "An act providing for the preservation of the State Lottery 3 Fund; further providing for pharmaceutical assistance for the 4 elderly; further providing for transportation assistance to 5 the elderly; providing for pharmaceutical purchasing; 6 conferring powers and duties upon the Department of Aging, 7 the Department of Revenue and the Department of 8 Transportation; imposing penalties; and making repeals," 9 excluding prescription costs from income. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. The definition of "income" in section 302 of the 13 act of August 14, 1991 (P.L.342, No.36), known as the Lottery 14 Fund Preservation Act, is amended to read: 15 Section 302. Definitions. 16 The following words and phrases when used in this chapter 17 shall have the meanings given to them in this section unless the 18 context clearly indicates otherwise:
1 * * * 2 "Income." All income from whatever source derived, including 3 but not limited to salaries, wages, bonuses, commissions, income 4 from self-employment, alimony, support money, cash public 5 assistance and relief, the gross amount of any pensions or 6 annuities including railroad retirement benefits, all benefits 7 received under the Federal Social Security Act (except Medicare 8 benefits), all benefits received under State unemployment 9 insurance laws and veterans' disability payments, all interest 10 received from the Federal Government or any state government, or 11 any instrumentality or political subdivision thereof, realized 12 capital gains, rentals, workmen's compensation and the gross 13 amount of loss of time insurance benefits, life insurance 14 benefits and proceeds, except the first $5,000 of the total of 15 death benefits payments, and gifts of cash or property, other 16 than transfers by gift between members of a household, in excess 17 of a total value of $300, but shall not include surplus food or 18 other relief in kind supplied by a government agency or property 19 tax rebate. All costs of prescription drugs, including 20 copayments, shall be deducted from income for purposes of 21 determining eligibility for assistance under this chapter. 22 * * * 23 Section 2.
