                                     AN ACT

     1  Amending the act of June 1, 1956 (P.L.1959, No.657), entitled,
     2     as amended, "An act fixing the salaries and compensation of
     3     the Chief Justice and judges of the Supreme Court, the
     4     President Judge and judges of the Superior Court, the judges
     5     of the courts of common pleas, the judges of the orphans'
     6     courts, the judges of the County Court of Philadelphia and
     7     the judges of the County Court and Juvenile Court of
     8     Allegheny County, certain associate judges not learned in the
     9     law, certain state officers, and the salary and expenses of
    10     the members of the General Assembly, and repealing certain
    11     inconsistent acts," changing the authority of the commission
    12     and provisions relating to establishment of salaries.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Subsection (b) of section 14.2, act of June 1,
    16  1956 (P.L.1959, No.657), entitled, as amended, "An act fixing
    17  the salaries and compensation of the Chief Justice and judges of
    18  the Supreme Court, the President Judge and judges of the
    19  Superior Court, the judges of the courts of common pleas, the
    20  judges of the orphans' courts, the judges of the County Court of
    21  Philadelphia and the judges of the County Court and Juvenile


     1  Court of Allegheny County, certain associate judges not learned
     2  in the law, certain state officers, and the salary and expenses
     3  of the members of the General Assembly, and repealing certain
     4  inconsistent acts," added June 29, 1976 (P.L.452, No.111), is
     5  amended to read:
     6     Section 14.2.  * * *
     7     (b)  The commission shall make an exhaustive study of the
     8  salaries, emoluments, mileage, per diem, travel and other
     9  expense allowances and reimbursements of the Governor, the
    10  Lieutenant Governor, the cabinet officers, the Auditor General
    11  and the State Treasurer, the justices and judges of the Supreme
    12  Court, the Superior Court, the Commonwealth Court, the courts of
    13  common pleas, the Municipal Court of Philadelphia and the
    14  Traffic Court of Philadelphia, and the officers and members of
    15  the General Assembly. As soon as is practicable after the
    16  effective date of this act for the initial report, and
    17  thereafter for subsequent reports no later than 31 days before
    18  the commencement of each term of the members of the General
    19  Assembly, the commission shall submit to the Governor, the Chief
    20  Justice, the President pro tempore of the Senate and the Speaker
    21  of the House of Representatives its report [establishing]
    22  recommending such salaries, emoluments, mileage, per diem,
    23  travel and other expense allowances.
    24     [The initial report shall take effect immediately, unless,
    25  within 30 days following the date of submission thereof the
    26  General Assembly shall, by concurrent resolution reject the
    27  report, in whole or part, or enacts legislation as hereinafter
    28  provided in this section. Reports submitted subsequent to the
    29  initial report shall take effect and have the force and effect
    30  of law at the beginning of the first pay period of the

     1  subsequent term of the General Assembly or the date of
     2  assumption of office of persons affected thereby after such
     3  date, unless within 30 days following the date of submission
     4  thereof, the General Assembly shall, by concurrent resolution,
     5  reject the said report, in whole or in part, or unless within
     6  said period the General Assembly shall enact legislation which
     7  establishes a rate of pay or allowance differing from that
     8  recommended by said report in whole or in part. That portion of
     9  the report which is not inconsistent with the resolution or
    10  legislation so adopted shall have the force and effect of law as
    11  herein provided.]
    12     The reports of the commission shall have only the effect of
    13  recommending salaries to the General Assembly. The General
    14  Assembly may accept or reject the report of the commission in
    15  whole or in part as it deems necessary. In order for any
    16  salaries to be changed it shall be necessary for the General
    17  Assembly to establish such changes by concurrent resolution
    18  within 30 days following the date of submission of the report of
    19  the commission.
    20     Section 2.  This act shall take effect immediately.
