7 (a) Written notice.--Upon the first face-to-face contact
8with the patient or the patient's legal representative and
9before the first service delivery, a hospital shall provide a
10written notice in plain language that describes:

11(1) the patient's classification as being on outpatient
12status and not inpatient status; and

13(2) the impact the outpatient status classification will
14have on the prior three-day inpatient stay required for
15Medicare coverage of skilled-nursing facility services as
16outlined under 42 CFR 409.30(a)(1) (relating to basic
17requirements).

18(b) Hospital duties.--Upon the determination of the 
19patient's observation status, a
