2The General Assembly finds and declares as follows:
3(1) To provide children with an understanding of the
4importance of the protection of human rights and the
5potential consequences of unchecked ignorance, discrimination
6and persecution, it is a matter of high priority that
7children in this Commonwealth be educated concerning the
8Holocaust, genocide and other human rights violations.
9(2) Therefore, the General Assembly strongly encourages
10school entities in this Commonwealth to offer instruction in
11the Holocaust, genocide and other human rights violations.

15(f) The State Board of Education shall:
16(1) Conduct a study regarding the manner in which
17instruction in the Holocaust, genocide and human rights
18violations is offered by school entities in this Commonwealth.
19In conducting the study, the State Board of Education shall
20request that each school entity provide the State Board of
21Education with information concerning whether the school entity
22offers such instruction and the manner in which such instruction
23is offered. Each school entity shall provide information to the
24State Board of Education in response to a request under this
25paragraph. Following the 2016-2017 school year, but not later
26than November 30, 2017, the State Board of Education shall issue
27a report to the Governor, the Secretary of Education, the
28Chairman and Minority Chairman of the Education Committee of the
29Senate and the Chairman and Minority Chairman of the Education
30Committee of the House of Representatives addressing the
31following:
32(i) The number of school entities offering
33instruction in the Holocaust, genocide and human rights
34violations.
35(ii) The number of school entities using the
36curriculum guidelines established by the Department of
37Education under subsection (b).
38(iii) The number of school entities using the in-
39service training programs made available by the
40Department of Education under subsection (c).
41(iv) A description of the manner in which school
42entities are offering instruction in the Holocaust,
43genocide and human rights violations, including the
1number of hours of instruction offered, the grade levels
2at which such instruction is offered and the course
3within such instruction is integrated.
4(v) The recommendations for improvements to the
5offering of instruction in the Holocaust, genocide and
6human rights violations, including recommended
7legislation.
8(2) Adopt a regulation, pursuant to the act of June 25,
91982 (P.L.633, No.181), known as the "Regulatory Review Act,"
10to require school entities to offer instruction in the
11Holocaust, genocide and human rights violations that is
12consistent with subsections (a) and (b), if the study
13conducted by the State Board of Education under paragraph (1)
14demonstrates that less than ninety percent of the school
15entities are offering instruction in the Holocaust, genocide
16and human rights violations consistent with subsections (a)
17and (b).
