1Amend Bill, page 1, lines 5 through 8, by striking out all of
2said lines and inserting
3Section 1. Section 2709(b) and (c)(2) of Title 18 of the
4Pennsylvania Consolidated Statutes, amended November 27, 2013
5(P.L.1061, No.91), are amended, subsection (b.1) is amended by
6adding a paragraph and subsection (f) is amended by adding
7definitions to read:
8Amend Bill, page 1, lines 11 through 14; page 2, lines 1
9through 13, by striking out "Cyber harassment of a child.--" in
10line 11, all of lines 12 through 14 on page 1 and all of lines 1
11through 13 on page 2 and inserting
12 Cyber harassment of a child.--A person commits the crime
13of cyber harassment of a child if, with intent to harass, he
14engages in a continuing course of conduct by repeatedly
15communicating the following by electronic means directly to a
16child or by publication through an electronic social media
17service:
18(1) A statement or opinion about the child's sexuality
19or sexual activity.
20(2) A seriously disparaging statement or opinion about
21the child's physical characteristics or mental or physical
22health or condition.
23(3) A threat to inflict unlawful harm.
24Amend Bill, page 2, lines 22 through 24, by striking out all
25of said lines and inserting
26(2) An offense under subsection (a)(4), (5), (6) or (7)
27or (b) shall constitute a misdemeanor of the third degree.
28Amend Bill, page 2, line 30; page 3, lines 1 through 9, by
29striking out all of said lines on said pages and inserting
30"Emotional distress." A temporary or permanent state of
31mental anguish.
1Amend Bill, page 3, by inserting between lines 12 and 13
2"Seriously disparaging statement or opinion." A statement or
3opinion which is intended to and under the circumstances is
4reasonably likely to cause serious emotional distress to a child
5of the victim's age.
