4 | Section 2. Section 1706-F(a) of the act, added October 9, |
5 | 2009 (P.L.451, No.48), is amended to read: |
6 | Section 1706-F. Limitations. |
7 | (a) Amount.-- |
8 | (1) The total aggregate amount of all tax credits |
9 | approved shall not exceed $67,000,000 in a fiscal year. No |
10 | less than $44,666,667 of the total aggregate amount shall be |
11 | used to provide tax credits for contributions from business |
12 | firms to scholarship organizations. No less than $22,333,333 |
13 | of the total aggregate amount shall be used to provide tax |
14 | credits for contributions from business firms to educational |
15 | improvement organizations. |
16 | (2) (i) For the fiscal years 2004-2005, 2005-2006 and |
17 | 2006-2007, the total aggregate amount of all tax credits |
18 | approved for contributions from business firms to pre- |
19 | kindergarten scholarship programs shall not exceed |
20 | $5,000,000 in a fiscal year. |
21 | (ii) For the fiscal year 2007-2008 and each fiscal |
22 | year thereafter, the total aggregate amount of all tax |
23 | credits approved for contributions from business firms to |
24 | pre-kindergarten scholarship programs shall not exceed |
25 | $8,000,000 in a fiscal year. |
26 | (3) (i) From the tax credits for contributions by |
27 | business firms to educational improvement organizations, |
28 | 10% of the available amount shall initially be set aside |
29 | for contributions by business firms to educational |
30 | improvement organizations that provide donations to |
31 | career and technical schools and shall be distributed in |
32 | accordance with section 1705-F(g). |
33 | (ii) Tax credits remaining from the amount set aside |
34 | in subparagraph (i) after July 1 of each year shall be |
35 | made available to business firms for contributions to any |
36 | educational improvement organization and shall be |
37 | distributed in accordance with section 1705-F(g). |
