18 | § 3311. Short title of subchapter. |
19 | This subchapter shall be known and may be cited as the Clean |
20 | Transit Act. |
21 | § 3312. Definitions. |
22 | The following words and phrases when used in this subchapter |
23 | shall have the meanings given to them in this section unless the |
24 | context clearly indicates otherwise: |
25 | "Dedicated compressed natural gas bus." A bus which runs |
26 | solely on compressed natural gas. |
27 | "Department." The Department of Environmental Protection of |
28 | the Commonwealth. |
29 | "Large mass transit authority." A mass transit authority |
30 | located in this Commonwealth that exceeds 245,000 revenue |
31 | vehicle hours for two consecutive years. |
32 | "Mass transit authority." An operator of regularly scheduled |
33 | transportation that is available to the general public and is |
34 | provided according to published schedules along designated |

1 | published routes with specified stopping points for the taking |
2 | on and discharging of passengers. The term does not include |
3 | exclusive ride taxi services, charter or sightseeing services, |
4 | nonpublic transportation or school bus or limousine services. |
5 | "Program." The Clean Transit Program. |
6 | § 3313. Clean Transit Program. |
7 | (a) Establishment.--The department shall establish and |
8 | administer the Clean Transit Program. |
9 | (b) Purpose.--The program is established in order to |
10 | decrease emissions from mass transit buses by utilizing natural |
11 | gas as a vehicle fuel. |
12 | (c) Transfer of funds.--The State Treasurer shall transfer |
13 | from the Oil and Gas Lease Fund to the department the sum of |
14 | $7,500,000 to fund the program. |
15 | (d) Use of funds.--The sum of $7,500,000 shall be deposited |
16 | into a fund to be administered by the department and made |
17 | available to large mass transit authorities for the purchase of |
18 | new dedicated compressed natural gas buses. The following shall |
19 | apply: |
20 | (1) The money in the fund is hereby appropriated on a |
21 | continuing basis to the Department of Environmental |
22 | Protection for the purposes provided for in this subchapter. |
23 | (2) No more than 1.5% of the fund may be used for |
24 | administration. |
25 | (3) The department may set terms applicable to loans in |
26 | any manner it deems appropriate, subject to the provisions of |
27 | this subchapter. |
28 | (e) Application process.-- |
29 | (1) A mass transit authority must complete and submit to |
30 | the department a clean transit loan application. |
31 | (2) Approved applications must obligate the mass transit |
32 | authority to contract with a private company: |
33 | (i) to build exclusively with private funds; and |
34 | (ii) to maintain and operate any new compressed |
35 | natural gas fueling facility necessary to support |
36 | compressed natural gas buses purchased with funds |
37 | received under this act. |
38 | (3) The term "operate" as used in this subsection shall |
39 | not include the actual act of fueling buses. |
40 | (f) Eligible costs.-- |
41 | (1) Loan funds received under this subchapter shall be |
42 | eligible for: |
43 | (i) Federally assisted purchases of new dedicated |
44 | compressed natural gas buses and shall be limited to the |
45 | total percentage of the State and local match. |
46 | (ii) Nonfederally assisted bus purchases and shall |
47 | be limited to 50% of the total incremental cost of a new |
48 | compressed natural gas bus. |
49 | (2) The incremental cost shall be capped at $60,000 for |
50 | buses which have a gross vehicle weight rating over 26,000 |
51 | pounds and $35,000 for buses with a gross vehicle weight |

1 | rating of 26,000 pounds and under. |
2 | (3) Buses with a gross vehicle weight rating of less |
3 | than 16,000 pounds shall be ineligible. |
4 | (4) Priority shall be given to those applications which |
5 | provide for public access to compressed natural gas vehicle |
6 | fueling dispensers. |
7 | (g) Loan program.--The department shall establish a formula |
8 | and method for awarding of loans under the program consistent |
9 | with this subchapter. |
10 | (h) Fund repayment.-- |
11 | (1) Loans disbursed from the fund under subsection (d) |
12 | shall be repaid to the Oil and Gas Lease Fund within five |
13 | years from disbursement and before June 30, 2021. |
14 | (2) On June 30, 2021, no money shall be deposited into |
15 | the fund and any remaining money in the fund shall be |
16 | transferred to the Oil and Gas Lease Fund. |
17 | (3) The interest rate for loans provided by the program |
18 | shall not exceed 2%. |
19 | (i) Appeal process.--Applicants that are not awarded grants |
20 | under this subchapter shall not have the right to a hearing or |
21 | the issuance of an adjudication under section 4 of the act of |
22 | July 13, 1988 (P.L.530, No.94), known as the Environmental |
23 | Hearing Board Act, regarding the department's decision. |
