§ 1524.  Local option.

8

(a)  Referendum.--Prior to the expansion of gaming to table

9

games in this Commonwealth, in any municipality in which a

10

licensed facility is located, a referendum shall be held on the

11

date of the general or primary election immediately preceding

12

any general election to determine the will of the electors with

13

respect to the expansion of gaming to table games within the

14

limits of the municipality under the provisions of this title.

15

Where an election was held at the primary election in any year,

16

another election may not be held under the provisions of this

17

section sooner than four years after the prior election.

18

Whenever electors equal to 25% of the highest vote cast for any

19

office in the county at the last preceding general election file

20

a petition with the board of elections of the county to place a

21

question on the ballot and a copy of the resolution is filed

22

with the board of elections of the county, the county board of

23

elections shall cause the following question to be placed on the

24

ballot or on the voting machine board in the municipality:

25

Do you favor the expansion of gaming to table games in the

26

municipality of             ?

27

(b)  Vote.--No expansion of gaming to table games shall be

28

granted unless the majority of the electors voting on the

29

question vote "yes," but if a majority of the electors voting on

30

the question vote "no," then the board or licensed entity shall

31

not expand gaming to table games in that municipality unless at

32

an election at least four years later a majority of the voting

33

electors vote "yes" on the question.

34

(c)  Voting procedure.--Proceedings under this section shall

35

be in accordance with the act of June 3, 1937 (P.L.1333,

No.320), known as the Pennsylvania Election Code,.

(d)  Withdrawal of approval.--The referendum procedure under

3

subsection (a) shall be available to withdraw the approval of

4

the expansion of gaming to table games that was granted through

5

a prior referendum. In accordance with the procedure in

6

subsection (a), the county board of elections shall cause the

7

following question to be placed on the ballot or on the voting

8

machine board in the municipality:

Do you favor discontinuing the expansion of gaming to table

10

games in the municipality of                ?

11

If a majority of the electors voting on the question vote "yes,"

12

the operation of table games shall cease at the licensed

13

facility within 60 days of the election.
