of said lines and inserting

(a)  Grading.--An employer, or an officer or an agent of

the employer, who intentionally violates section 5(a)

commits:

(1)  A misdemeanor of the third degree for a first

7

offense.

(2)  A misdemeanor of the second degree for a second or

9

subsequent offense.
