AMENDMENTS TO SENATE BILL NO. 180

1 Amend Title, page 1, line 3, by removing the period after
2 "veterans" and inserting
3 and for termination of certain health insurance benefits; and
4 adding a definition of "ancillary service plans."
5 Amend Sec. 1, page 1, lines 6 and 7, by striking out all of
6 said lines and inserting
7 Section 1. Sections 705(a) and 7309(d) and (e) of Title 51
8 of the Pennsylvania Consolidated Statutes are amended to read:

10 § 7309. Employment discrimination for military membership or
11 duty.

13 (d) Termination of certain health insurance benefits.--
14 (1) As used in this subsection, the term "eligible
15 member" applies to full-time students who are eligible for
16 health insurance coverage or ancillary service plans under
17 their parents' health insurance policies when the students
18 are:
19 (i) members of the Pennsylvania National Guard or
20 any reserve component of the armed forces of the United
21 States who are called or ordered to active duty, other
22 than active duty for training, for a period of 30 or more
23 consecutive days; or
24 (ii) members of the Pennsylvania National Guard
25 ordered to active State duty, including duty under 35
26 Pa.C.S. Ch. 76 (relating to Emergency Management
27 Assistance Compact), for a period of 30 or more
28 consecutive days.
29 (2) As used in this subsection, the term "full-time
30 student" shall have the same meaning set forth in Chapter 32
31 (relating to Educational Assistance Program).
32 (3) The eligibility for health insurance coverage or
33 ancillary service plans under a parent's health insurance
34 policy for eligible members as defined in paragraph (1) shall
35 be extended for a period equal to the duration of the
36 eligible member's service on active duty or active State duty
37 or until the eligible member is no longer a full-time
1 student. The eligibility of an eligible member who is a full-
2 time student for health insurance coverage or ancillary
3 service plans under a parent's policy shall not terminate
4 because of the age of the eligible member when the member's
5 educational program was interrupted because of military duty.
6 (4) In order to qualify for this extension, the eligible
7 member must:
8 (i) Submit a form approved by the Department of
9 Military and Veterans Affairs notifying the insurer that
10 the eligible member has been placed on active duty.
11 (ii) Submit a form approved by the Department of
12 Military and Veterans Affairs notifying the insurer that
13 the eligible member is no longer on active duty.
14 (iii) Submit a form approved by the Department of
15 Military and Veterans Affairs showing that the student
16 has reenrolled as a full-time student for the first term
17 or semester starting 60 or more days after his or her
18 release from active duty.
19 (5) The provisions of this subsection shall not apply to
20 a health insurance policy or ancillary service plan that has
21 been terminated.
22 (e) Definitions.--As used in this section, the following
23 words and phrases shall have the meanings given to them in this
24 subsection:
25 "Ancillary service plans." Any individual or group health
26 insurance plan, subscriber contract or certificate that provides
27 exclusive coverage for dental services or vision services.
28 "Health insurance policy." An individual or group health,
29 sickness or accident policy or subscriber contract or
30 certificate issued by an entity subject to any one of the
31 following:
32 (1) The act of May 17, 1921 (P.L.682, No.284), known as
33 The Insurance Company Law of 1921.
34 (2) The act of December 29, 1972 (P.L.1701, No.364),
35 known as the Health Maintenance Organization Act.
36 (3) The act of May 18, 1976 (P.L.123, No.54), known as
37 the Individual Accident and Sickness Insurance Minimum
38 Standards Act.
39 (4) 40 Pa.C.S. Ch. 61 (relating to hospital plan
40 corporations) or 63 (relating to professional health services
41 plan corporations).
42 Amend Sec. 2, page 1, line 14, by striking out "in 60 days."
43 and inserting
44 immediately.
