H2200B3176A05747 DMS:JMM 02/07/08 #90 A05747 AMENDMENTS TO HOUSE BILL NO. 2200 Sponsor: REPRESENTATIVE ROSS Printer's No. 3176 1 Amend Sec. 2 (Sec. 2806.1), page 7, line 21, by inserting 2 after "established." 3 The program administrator, or its appointed fiscal agent, shall 4 administer any and all funds to be used as payments to the 5 third-party entities, and shall disburse said funds upon finding 6 by the program administrator that the selected third-party 7 entity complied with the terms of the agreement between the 8 program administrator and the selected third-party entity. 9 Amend Sec. 2 (Sec. 2806.1), page 8, lines 20 and 21, by 10 striking out all of line 20 and inserting 11 (2) Upon approval by the commission of a recommendation 12 by the program administrator for selection of a third-party 13 entity to 14 Amend Sec. 2 (Sec. 2806.1), page 8, lines 29 and 30; pages 9 15 and 10, lines 1 through 30; page 11, lines 1 through 3, by 16 striking out all of said lines on said pages and inserting 17 (e) Plan goals.-- 18 (1) The program administrator shall ensure that each 19 proposal submitted by a third-party entity to deliver a 20 program of energy efficiency measures includes meeting the 21 goal of reaching an incremental annual energy savings based 22 on a percentage of all electricity sold in calendar year 2007 23 of 0.4% in 2010 and 2.5% in 2014 and each year thereafter. 24 The program administrator shall ensure that a third-party 25 entity meets the goals contained in this section through the 26 implementation of a program of energy efficiency measures 27 throughout the service territory of the electric distribution 28 company. After December 31, 2014, the commission, in 29 consultation with the program administrator, may adopt 30 additional incremental energy efficiency goals. These 31 additional incremental goals may be based upon, but not 32 limited to: the costs and benefits associated with energy 33 efficiency measures, updated or new technologies and economic 34 conditions that may exist at the time the additional 35 incremental goals are being considered. The commission shall
1 undertake a public hearing process to receive input regarding 2 new proposed new incremental goals prior to their 3 implementation. 4 (2) The program administrator shall ensure that each 5 proposal submitted by a third-party entity to deliver a 6 program of demand-side response measures includes meeting the 7 goal of reducing peak demand from a target year being the 8 calendar year 2007 on a weather-normalized basis and adjusted 9 to eliminate the effect of emergency load control procedures 10 implemented by a regional transmission organization by an 11 amount equal to 2.0% in the 100 hours of highest demand in 12 2010, 4.0% in the 100 hours of highest demand in 2012 and 13 each year thereafter. The program administrator shall ensure 14 a third-party entity meets the goals contained in this 15 section through the implementation of a program of demand- 16 side resources measures throughout the service territory of 17 the electric distribution company. After December 31, 2012, 18 the commission, in consultation with the program 19 administrator, may adopt additional incremental peak load 20 reduction goals. These additional incremental goals may be 21 based upon, but not limited to: the costs and benefits 22 associated with demand-side response measures, updated load 23 growth forecasts and economic conditions that may exist at 24 the time the additional incremental goals are being 25 considered.
