Prohibited conduct during emergency. 9 (a) General rule.--No person shall carry a firearm[, rifle 10 or shotgun] upon the public streets or upon any public property 11 during an emergency proclaimed by a State or municipal 12 governmental executive unless that person is: 13 (1) Actively engaged in a defense of that person's life 14 or property from peril or threat. 15 (2) Licensed to carry firearms under section 6109 16 (relating to licenses) or is exempt from licensing under 17 section 6106(b) (relating to firearms not to be carried 18 without a license). 19 (b) Seizure, taking and confiscation.--Except as otherwise 20 provided under subsection (a) and notwithstanding the provisions 21 of 35 Pa.C.S. Ch. 73 (relating to Commonwealth services) or any 22 other provision of law to the contrary, no firearm, accessory or 23 ammunition may be seized, taken or confiscated during an 24 emergency unless the seizure, taking or confiscation would be 25 authorized absent the emergency. 26 (c) Definitions.--As used in this section, the following 27 words and phrases shall have the meanings given to them in this 28 subsection: 29 "Accessory." Any scope, sight, bipod, sling, light, 30 magazine, clip or other related item that is attached to or 31 necessary for the operation of a firearm. 32 "Firearm." The term includes any weapon that is designed to 33 or may readily be converted to expel any projectile by the 34 action of an explosive or the frame or receiver of any weapon. C28L90DMS/HB1845A06467
