     1       Amend Sec. 1 (Sec. 4), page 4, line 13, by inserting after
     2    "(e)"
     3               (1)
     4       Amend Sec. 1 (Sec. 4), page 4, by inserting between lines 15
     5    and 16
     6       (2)  A municipality shall not be required to implement a
     7    zoning ordinance under subsection (a) if, on the effective date
     8    of this subsection, all of the property adjoining the
     9    Appalachian Trail in the municipality is:
    10       (i)  owned by the Department of Conservation and Natural
    11    Resources; or
    12       (ii)  operated as a game preserve by a nonprofit, nonstock
    13    corporation which is qualified as an exempt organization under
    14    section 501(c) of the Internal Revenue Code of 1986 (Public Law
    15    99-514, 26 U.S.C. § 501(c)).
    16       (3)  If title to property under paragraph (2) is transferred
    17    or the use of such property changes, the municipality shall
    18    implement a zoning ordinance under subsection (a) within one
    19    year of the date the title to the property is transferred or the
    20    use of the property changes.
