Subject: DUI Offender Reform Legislation
 
In the near future, we will reintroduce Senate Bill 1031 of last session which will update and make several technical changes to Pennsylvania’s DUI law. Due to several recent cases from the U.S. Supreme Court and the Pennsylvania Supreme Court, updates are necessary to ensure our statutes reflect those decisions. 
 
These changes include: 

  • Clarifying Title 75, Section 1543 and Title 42, Section 9756 to address a Pennsylvania Supreme Court case (Commonwealth v. Eid) where it was determined that the sentencing statute must specify the range of available sentences with “sufficient clarity.” 
  • Refining Title 75, Section 1543 to add provisions that were missed in Act 30 of 2017 (Birchfield v. North Dakota). 
  • Updates Title 75, Section 3807 to address how a first offense is determined (Commonwealth v. Chichkin). 

Additionally, our legislation will modernize Title 75, Section 1556 and Section 3805 to improve how an ignition interlock is installed and managed (originally enacted via Act 33 of 2016).
