Subject: COVID-19 Limited Liability Protections for Medical Care and Equipment
 
I will be reintroducing Senate Bill 1181 of last session to provide immunity from liability for certain providers and facilities providing medical care to individuals with COVID-19. This legislation will also provide immunity from liability for damages from equipment and other goods used in response to COVID-19.  Previous cosponsors included Senators Argall, Stefano, Hutchinson, Phillips-Hill and Martin.
 
We find ourselves looking for any and all resources to help the citizens of this Commonwealth; to protect individuals from ever being infected with COVID-19 and to ensure hospitals and healthcare professionals have an adequate supply of equipment and other supplies needed to treat individuals who unfortunately have contracted COVID-19.  The provisions of this legislation will only be applicable to suits that do not rise to the level of gross negligence or reckless and intentional conduct. 
 
Several states have already enacted similar measures.  It is imperative that we provide adequate protections for our providers and workers.  Flexibility is essential to provide the critical assistance and care required during this unprecedented emergency.
