Senate of Pennsylvania
Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: December 18, 2020 10:35 AM
From: Senator Patrick J. Stefano
To: All Senate members
Subject: Expanding Pennsylvania's Automobile Lemon Law

In the near future, I plan to re-introduce legislation that will expand Pennsylvania’s Automobile Lemon Law to include municipal road construction and maintenance equipment.

Under the proposed expansion “Road Equipment” will be defined as any new and unused equipment used to construct or maintain roads, streets, highways, berms, shoulders, and right-of-ways abutting a road, street or highway owned and maintained by the Commonwealth and its municipalities. In my district alone I am aware of numerous cases where municipal governments were forced to remedy issues to new equipment that would be covered by this expansion.

Many Pennsylvania residents have positively benefitted from the passage of the original Lemon Law in 1984. I think it is important to expand this protection to municipal road equipment to aid municipalities and ensure the equipment they purchase does not become an unnecessary financial hardship on it or its taxpayers.

This legislation was formerly Senate Bill 533 from last session and was co-sponsored by Senators Browne, Brewster, and Bartolotta

I hope that you join in me in co-sponsoring this legislation.  If you have any questions regarding this information, please contact Jake Gery in my office at jgery@pasen.gov.
