Subject: Amendment to the Private Detective Law
 
I will soon reintroduce legislation to modernize the Private Detective Law of 1953, which sets forth the rules for working in a private security guard position. According to the Bureau of Labor Statistics, in 2018 there were 42,900 people employed as security guards in Pennsylvania.
 
This measure will mirror Senate Bill 1237 from last session.

Under current law, individuals convicted of certain offenses are barred for life from working in a security guard position. Not only are the disqualifying offenses enumerated in the statute vague, they are inconsistent with a Pennsylvania Supreme Court ruling that found lifetime bans on employment based on criminal convictions to be unconstitutional. My bill, therefore, will specify certain criminal convictions that bar employment as a security guard for five years. 

The bill will also make similar changes to the provisions of the law relating to the issuance of licenses to private security companies. These changes cure the law’s constitutional defect and ensure our occupational licensure system in this area works in tandem with the broader reforms of re-entry and workforce development.
