Senate of Pennsylvania
Session of 2021 - 2022 Regular Session

MEMORANDUM

Posted: December 1, 2020 02:18 PM
From: Senator Michele Brooks
To: All Senate members
Subject: Establishing a Motorcycle Lemon Law

In the near future, I will be reintroducing legislation that will establish a Lemon Law for motorcycles, providing consumer protections for motorcycle buyers, just as we do for car buyers under Pennsylvania’s Automobile Lemon Law.

Currently, the Automobile Lemon Law protects those who purchase vehicles by requiring manufacturers to repair any defect that significantly affects the use, value, or safety of the vehicle, as long as the defect occurs within the first 12,000 miles or within the first year of ownership.

However, similar protections are not offered to those who purchase motorcycles, leaving the owner to either pay out of pocket to repair potentially dangerous manufacturing defects or fix the problem themselves. Last session, this legislation was revised and strengthened, thanks to the combined efforts of ABATE, motorcycle manufacturers and dealers, and other important stakeholders.

The language of this legislation mirrors that of Senate Bill 792 of last session, which passed the Senate,  but did not receive consideration in the House Consumer Affairs Committee before the close of session.  Bill cosponsors included Senators Gordner, Mastriano, Stefano, J. Ward, K. Ward, Costa, Collett, Muth and Brewster.

I hope you will join me in cosponsoring this important piece of legislation. Please do not hesitate to contact my office with any questions, and thank you for your consideration.
