Subject: Bituminous Mine Subsidence and Land Conservation Act Data Analysis Requirements
 
In the near future, I will introduce legislation to amend the Bituminous Mine Subsidence and Land Conservation Act to provide the Department of Environmental Protection (DEP) greater flexibility in controlling the costs in meeting the data analysis report requirements outlined in the Act.

The Bituminous Mine Subsidence and Land Conservation Act, as amended in 1994, requires that DEP compile data and, with the assistance of a third party, analyze the data every five years. Over the past two decades, DEP has issued four reports and is scheduled to release the fifth report this year. While the reports have consistently demonstrated the efficacy of the Bituminous Mine Subsidence and Land Conservation Act in achieving its legislative intent, the cost for DEP to complete the report has continuously and sharply risen.

Given this, my legislation would give DEP increased fiscal flexibility by removing the requirement to utilize a third-party and making the five-year report discretionary. Finally, the legislation would require that any report compiled is submitted to the House and Senate Environmental Resources and Energy Committees.
