Subject: Reinstating the Subsidized Permanent Legal Custodianship Program
 
I will soon introduce legislation to reinstate the permanent legal custodian and adoption assistance subsidies to children from 18 to 21 years of age. The federal subsidies are provided through the Subsidized Permanent Legal Custodianship Program, which allows family members who are granted permanent legal custodianship for qualified children under Kinship Care to receive a subsidy.

This program was codified in the Human Services Code in Act 80 of 2012, but was invalidated last July when the Pennsylvania Supreme Court ruled Act 80 unconstitutional on procedural grounds. My legislation reinstates the program retroactive to July 1, 2012 in order to remain eligible for federal Title IV-E funds.
