Subject: RADAR for Local Law Enforcement
 

In the near future, I intend to introduce legislation which I formerly prime sponsored as a member of the Pennsylvania House of Representatives and which I have strongly supported as a member of the Senate in which the companion bill was prime sponsored by Senator Randy Vulakovich, formerly Senate Bill 251 of 2017.

Radar technology was developed prior to and during World War II and radar speed guns were introduced into the marketplace in the 1950’s. All states but Pennsylvania permit their local police to use radar for monitoring traffic speed. In Pennsylvania, only the State Police are currently authorized to use radar. While we do not allow municipal police to utilize radar, we do allow certain municipalities to utilize red light camera systems. This legislation would permit all municipal police to utilize radar for speed enforcement.

This legislation includes:
  • A revenue cap on the amount of a money a municipality may keep from speeding tickets (20% of their municipal budget)
  • Requires a municipality adopt an ordinance to allow for police to use RADAR
  • Calibration standards for the use of RADAR guns.
This legislation is supported by the “Coalition to Eliminate the Prohibition Against Municipal Police Using Radar” -- the PA Chiefs of Police Association, PA Municipal League, Pennsylvania State Association of Boroughs, PA Association of Township Commissioners, PA State Association of Township Supervisors, PA State Mayors Association and Bike Pittsburgh.

Senate Bill 251 of 2017 sponsors included: VULAKOVICH, ALLOWAY, AUMENT, BARTOLOTTA, BLAKE, BREWSTER, COSTA, FONTANA, HAYWOOD, LEACH, MARTIN, MENSCH, RAFFERTY, SCAVELLO, SCHWANK, STEFANO, WHITE, YUDICHAK, BAKER and DINNIMAN
