Subject: | Additional Incentives For PA Companies To Utilize Film Tax Credits |
In the near future, I plan to introduce legislation that would amend the Film Tax Credit (FTC) Program within the Tax Reform Code. My legislation proposes to create additional incentives for related Pennsylvania companies to utilize film tax credits without having to transfer or sell those credits to an unrelated business. Specifically, the legislation would allow a corporate taxpayer who receives film tax credits to allocate those credits among its parent or sister companies that are part of the same consolidated federal income tax group. Current law stipulates that a current wholly owned subsidiary of the parent company can only offset 50% of the entity’s qualified tax liability for the year. This restriction should not apply in the case of related Pennsylvania companies. Instead, we should encourage these companies to utilize these credits within the family, if possible, which will encourage even more investments here in the Commonwealth. This legislation will be similar to SB 1214 of the 2017-18 Legislative Session which was co-sponsored by the following Senators: Browne, Bartolotta, Hughes, Reschenthaler and Kim Ward.
