Subject: Proposed Changes to the Home Rule Law
 
In the near future, I plan to re-introduce legislation (SB 1176 of the 2017-18 Session) amending Title 53 (Municipalities Generally) that would benefit the conduct of elections currently held in the Commonwealth.

Specifically, my legislation would amend Title 53 Pa.C.S. Section 2927(a) of the Home Rule Law to prohibit the filing of any ordinance or petition pursuant to the Home Rule Law for four (4) years following an election in which any of the three Home Rule Questions enumerated at 53 Pa.C.S Section 2911(a) appears on the ballot and is defeated.

The current language permits the three different Home Rule Questions to be placed on the ballot and defeated in three consecutive elections before additional proceedings would be prohibited.

Additionally, the legislation would further amend Title 53 Pa.C.S. Section 2911(d) of the Home Rule Law to permit a Home Rule Question to appear only on a November election ballot, and not on a primary ballot.

These recommendations were presented to me and supported by the Association of Eastern Pennsylvania County Election Personnel and the Western Pennsylvania Election Personnel Association.
