Subject: Complying with PA's Steel Products Procurement Act
 
I have been made aware of an issue that is an administrative burden for both the PA Department of Transportation and the Highway construction industry in complying with Pennsylvania’s Steel Products Procurement Act. Specifically, the act provides that “unidentifiable” steel or products that cannot be physically marked must be documented as melted and manufactured in the United States. Federal Auditors on several DOT projects determined that the department may not be complying with Pennsylvania’s Steel Products Procurement Act.

To insure compliance with the act and federal auditors, the department has required that documentation of unmarked steel products be provided to each project inspector and maintained by the department’s personnel. The documentation must include physical copies of invoices, bills of lading and mill certification. PennDOT has identified this as a costly and inefficient administrative burden. PennDOT and the highway construction industry have proposed an amendment to the act to provide the maintenance of a system of verifiable, traceable records that can be audited to ensure compliance rather than the current burdensome system. My bill will provide the necessary amendments to the act to do this.
