| Subject: | legislation to eliminate the waste designation for steel slag |
| In the near future I plan to introduce legislation to eliminate the waste designation for steel slag when it is being sold in the stream of commerce and is not a discarded material. Slag is a reliable, cost-effective aggregate that has been used in several capacities in Pennsylvania and in many other states for decades. Steel slag is being manufactured intentionally for sale and marketing. After slag is manufactured it is initially considered a waste. In order to sell steel slag product, steel mills and slag processors must pursue classification as a co-product or obtain a permit for the beneficial use of waste. This approval process is administered by DEP. Slag has proven to be an environmentally safe product for many years. Eliminating the waste distinction would help ease the regulatory burden on the slag industry would help encourage the use of this sustainable and environmentally safe material. In recent years, several states have indicated that slag is not a waste if it is not discarded and if it is distributed for commerce. North Carolina, South Carolina, Texas, Tennessee, Iowa, Nebraska, Alabama and Washington have passed legislation to make this change. Utah and Indiana have made this change through their regulatory process. In the previous session Senate Bill 1377 was co-sponsored by Senators Bartolotta, Hutchinson, Mensch, Reschenthaler, Scarnati, Vulakovich, Ward and White.
