MEMORANDUM

Subject: Establishing Separate Snowmobile and All-Terrain Vehicle (ATV) Funds
 
In the near future, I plan to introduce legislation to amend Chapter 77, known as the Snowmobile and All-Terrain Vehicle Law, of Title 75 (Vehicle Code).

Currently, all moneys received from the registration, certification, sale of publications or services, and enforcement activity of ATVs and snowmobiles is placed in a restricted account. Funds are then drawn from this account to aid in continued operations of the previously mentioned activities, as well as construction and maintenance of snowmobile and ATV trails and acquisition of equipment, supplies and interests in land.

DCNR does not currently separate expenditures related to ATV and snowmobile projects and as a result these funds are being disproportionately allocated between user groups. Although ATV operations contribute $1.4 million of the $1.6 million fund, 80% is allocated to expansion of snowmobile trails.

This legislation will ensure that equitable distribution of funds takes place and that there is better defined accounting of these dollars. The stated purpose and funding streams related to the accounts will remain unchanged.

Additionally, ATV use in Pennsylvania has a very positive impact on regional economies. This legislation would change the composition of the Snowmobile and ATV Advisory Board to reflect this impact by eliminating the two non-motorized members and replacing them with a representative from DCED and from the Pennsylvania Economic Development Association.
