Subject: | The State-Owned University Intellectual Property Act |
Please join me in co-sponsoring The State-Owned University Intellectual Property Act. Last session, this bill was Senate Bill 1440 which passed the Senate unanimously. In order for our State-owned universities to attract and retain talented faculty members, we must ensure their intellectual property rights are protected at the same level as faculty at private colleges and universities in the Commonwealth. When The State System of Higher Education Intellectual Property Act (Act 132 of 2012) was passed, the Repeal and Effective Date sections were mistakenly excluded from publication in Purdon’s Pennsylvania Statutes. Because of this error, the State System was not referencing the complete Act when making determinations about the commercialization of intellectual property at State-owned universities. Specifically, this legislation will change the name of The State System of Higher Education Intellectual Property Act to The State-Owned University Intellectual Property Act and will repeal Chapter 11 (relating to ethics standards and financial disclosure) of the Public Official and Employee Ethics Act, insofar as it is inconsistent with this Act. The above referenced changes along with the Purdon’s correction will make it less burdensome for faculty at State-owned universities to build partnerships with the private sector to conduct research and commercialize intellectual property. |
