MEMORANDUM

Posted: February 2, 2015 03:52 PM
From: Senator John H. Eichelberger, Jr.
To: All Senate members
Subject: Termination of Sewer Service to commercial properties

In my district, as in other more rural areas, many properties are serviced by a municipal sewer authority, but obtain water from a well. Currently, other municipal sewer authorities can enforce payment of sewer bills by obtaining a shutoff of water service. However, sewer authorities who service properties with well water do not have this option.

I plan to introduce legislation which would enable a sewer authority to obtain a court order allowing it to terminate sewer service to commercial customers who are seriously delinquent (at least 6 months) in payment of sewer bills. The bill would provide for additional notices to the owner and health departments of the date service would be terminated.

Introduced as SB534
