Subject: | Emergency and Law Enforcement Personnel Death Benefits Act |
In the near future I plan to introduce legislation that will amend the Emergency and Law Enforcement Personnel Death Benefits Act. The benefit applies to law enforcement officers, ambulance service or rescue squad members, firefighters, certified hazardous material response team members, and National Guard members. As the law currently stands, should the aforementioned perish as a result of their duties, the benefit must be applied for within 90 days from the date of death. My legislation would extend it to three years from the time of death. Under most circumstances the 90 day window would be fine, but there are instances where matters become more complex, such as estate settlement or other legal issues, and more time is needed. This change will also make the state benefit uniform with the federal benefit and eliminate any confusion. |
