Senate of Pennsylvania
Session of 2013 - 2014 Regular Session

MEMORANDUM

Posted: December 17, 2013 02:37 PM
From: Senator Kim L. Ward
To: All Senate members
Subject: MEMO #32 - Reinstating municipal police jurisidiction for the Westmoreland County Park Police

I plan on introducing legislation that would reinstate a section of law included in Act 152 of 2004, which was recently struck down as unconstitutional by the PA Supreme Court for a failure of the single-subject rule.

The bill I am proposing will reinstate the municipal police jurisdiction of the Westmoreland County Park Police, thereby enabling the Park Police to enforce the laws of this Commonwealth and perform the functions of their office. Specifically, the bill will amend the definition of “primary jurisdiction” under 42 Pa.C.S. §8951 (relating to municipal police jurisdiction) just as it was written in Act 152 of 2004.

If you have any questions about this legislation, please do not hesitate to contact my office. Thank you for your consideration of this request.

Introduced as SB1223
