Subject: Public Safety Fee on Fireworks
 
I am reintroducing legislation that amends Title 35 (Health and Safety) of Pennsylvania Consolidated Statutes. This was Senate Bill 1518 of the 2011-12 session of the General Assembly.

This legislation establishes the Municipal Fire and Emergency Services Organizations Grant Program. Grants provided under this program will be used by municipal fire and emergency services programs to enhance their capabilities. The municipal fire and emergency services programs can use the grants to construct and renovate their facilities; repair or purchase equipment; reduce debt associated with those two activities; and train and certify their members. Grants shall be between $2,500 and $15,000 per recipient, except in certain circumstances.

Under this bill, a 25 percent fee will be assessed on the sale of “consumer fireworks” sold at facilities licensed by the Department of Agriculture. (Note that this fee would not apply to sparklers and other novelties sold in tents and other retailers such as Walmart).

Of the revenues generated by the fee, $1 million shall be appropriated annually to pay for grants to eligible municipal fire and emergency services organizations. The remainder of the funds shall be appropriated in accordance with Section 7833 (b) of Title 35 (Health and Safety) of Pennsylvania Consolidated Statutes. The Pennsylvania Emergency Management Agency (PEMA) will administer the program.

Co-sponsors of Senate Bill 1518 were Senators Alloway, Brewster, Costa, Erickson, Pileggi, Schwank, Solobay, Tartaglione and Washington.
