Subject: Whistleblower protection for child abuse reporting (Corrected Memo)
 
I am introducing legislation to address a specific recommendation made by the Task Force on Child Protection established by Senate Resolution 250, not SR 20 as referred in a previously circulated memo. This legislation will adopt "whistleblower" protection individuals who report child abuse.

The bill will allow an employee to bring action for employment discrimination if:
  1. They are a mandated reporter,
  2. The person acted in good faith; and
  3. The person is fired or discriminated against in compensation, hire, tenure, terms, conditions or privileges of employment.
The action must be filed in the court of common pleas where the alleged unlawful discharge or discrimination occurred. Relief may include reinstatement with back pay and the Department of Public Welfare may intervene in an action.
