Subject: County Recycling Fees
 
Please join me in sponsoring legislation introduced as Senate Bill 863 in the 2011-2012 legislative session by Senators COSTA, HUGHES and TARTAGLIONE, that amends the Municipal Waste Planning, Recycling and Waste Reduction Act to allow counties to implement a fee of up to $4 to help them run their county recycling programs.

There were 38 counties that were collecting a fee to fund the local program when the fees were invalidated by a court decision in 2005 that held that counties did not have authorization to levy such a fee under the statute. The bill also contains an inflation adjustment so that the value of the fee is not diminished over time. The fee will only be re-adjusted every 5 years for inflation.
