Subject: Protecting Against Out-of-State Civil and Criminal Actions for Reproductive Health Services

It has become clear these past months that reproductive health care is under assault in our nation. Following the recent United States Supreme Court decision to overturn the Roe v. Wade precedent in Dobbs v. Jackson Women’s Health Organization, more and more states are moving forward with efforts to ban or severely restrict access to reproductive health care. In Pennsylvania, abortion is still safe and legal. Despite the threat of this right being stripped away come election day, we must do everything in our power as leaders to keep Pennsylvania a safe haven for reproductive rights.

In some states, there is talk of passing laws that would prevent residents from traveling to another state to access reproductive health care. This has led several states – such as New York and New Jersey – to consider counter legislation to protect anyone receiving, providing, and assisting in legal abortions within their borders. It is imperative in today’s world that we protect reproductive health care access for all, no matter an individual’s state of residence.

For this reason, we will be introducing legislation to ensure licensed professionals cannot be penalized for performing reproductive health services on an individual who resides in a state outside of Pennsylvania, where such services may be illegal. In addition, our legislation would also:

  • Allow people to bring civil action against any entity that has entered a judgement against them in another jurisdiction for reproductive health services they legally performed in Pennsylvania.

  • Prohibit the issuance of subpoenas, summons, or extradition of a person to another state for reproductive health services they legally performed in Pennsylvania.

Please join us in co-sponsoring this important legislation to protect health care providers and the right to reproductive health care access in Pennsylvania.
