Subject: Including State-Related Universities in the Right to Know Law
 
In the near future, I plan to introduce legislation that will amend the Right-to-Know Law (Act 3 of 2008) to included State-Related Universities (Temple, Lincoln, Penn State, and Pittsburgh).
 
Under the current law, the Pennsylvania State System of Higher Education (PASSHE), the Pennsylvania Higher Education Assistance Agency (PHEAA), and the Commonwealth’s community colleges are all subject to the provisions of the Right-to-Know Law. However, the four State-Related Universities are specifically exempt from this law, even though they annually receive taxpayer funding.  
 
My legislation would change this so that the four State-Related Universities and their associated branch campuses and graduate schools are subject to the provisions of the Right-to-Know Law. The legislation also provides some exceptions for research and development information, the identity of donors, unpublished materials, and information on examinations and testing. The State-Related Universities and their affiliates will also be required to file reports by May 30th of each year with the Governor’s Office, the General Assembly, the Auditor General, and the State Library, which include the following information:
 
  • All information required by Form 990 or an equivalent form of the United States Department of the Treasury, Internal Revenue Service, entitled the Return of Organization Exempt From Income Tax, regardless of whether the State-related institution and its affiliates are required to file the form by the Federal Government;
  • The salaries of all officers and directors; and
  • The highest 25 salaries paid to employees.
