MEMORANDUM

Subject: Duration of State of Emergency for Third Class Cities

In the near future I plan on introducing legislation that would update the Third Class City code to make the emergency powers provisions consistent with those found in Title 35 (Health and Safety).

Currently, the Third-Class City Code caps the duration of a state of emergency declared by the mayor or city council to 5 days, this provision contradicts Title 35 which provides for a 7-day duration unless extended by the governing body of the political subdivision. To reconcile this difference, my legislation would simply change the duration found within the Third-Class City Code to align with the 7 days found within Title 35.

Please join me in sponsoring this legislation so there is no confusion when a city declares a state of emergency.

Introduced as HB2116
